- How is Artificial Intelligence changing different sectors and what are the main ethical and regulatory challenges for its implementation?
Artificial Intelligence (AI) is causing a revolution in several economic sectors, such as in the health care area, by providing more accurate diagnoses with its application in examinations, or even in the finance area, from predictive data analysis to investments, and in the legal area, when helping review and manage contracts, researching precedents, and automating routine tasks of law professionals.
This revolution significantly impacts how personal and sensitive data is handled, how decisions are made, and especially how services are provided. For this reason, its implementation brings ethical and regulatory challenges that demand special attention, especially from the perspective of digital law and the protection of personal data, including algorithmic bias, privacy and data protection underlying the training of AI systems, transparent decision-making, and issues related to information security and cybersecurity.
- How can AI help prevent fraud and validate the authenticity of documents in Public Registries, considering the need to protect sensitive data?
This form of aid can be provided through the use of artificial intelligence systems to analyze patterns and spot anomalies in records and operations, such as attempts to forge digital signatures or even the illegal issuance of documents. Furthermore, facial recognition and biometrics systems can be used for authentication and confirmation of parties involved in operations, thus reducing the risks of misrepresentation, even allowing the integration of these systems with government databases, such as the Federal Revenue Service, National Council of Justice (CNJ), and Courts of Justice, for the purpose of validating information and documents presented at Public Registries.
Considering the sensitive data collected, the principle of data minimization and its possible anonymization should be observed when collecting this data, with a view to reducing risks of leaks, in addition to the transparency and explainability of the algorithms used, subject to audit, so that the decisions made by them can be duly reviewed and explained whenever needed.
- What are the challenges and regulations that need to be considered when implementing Artificial Intelligence solutions in Public Registries, especially in relation to privacy and compliance with LGPD?
We can mention as main challenges the guarantee of compliance with the principles established by LGPD regarding the purpose and need for data processed by AI systems; the use of appropriate legal bases for this handling, and ensuring transparency to data subjects as to the way their data is processed by AI systems, taking ethics by design into consideration, i.e., the need for ethical concerns from the system’s conception to its actual use.
